New horizons of tax control
The SPIBA Finance Committee will hold an expert session, during which we will discuss issues that are in the focus of the heads of financial and accounting departments.
Program:
1. New rules for reducing penalties for violations of tax legislation
Amendments will come into force on 01.09.2026, according to which the approach to the application of mitigating circumstances will significantly change. The Federal Tax Service has already developed a draft order providing for the reduction of circumstances recognized as mitigating the taxpayer’s liability. Let’s discuss how the new rules will work.
2. Tax control of online payments of citizens
Draft laws have been submitted to the State Duma that establish the legal basis for monitoring online payments of citizens in order to identify income hidden from personal income tax. The powers and procedure for interaction between the Central Bank and the Federal Tax Service within the framework of such control are determined. It is assumed that the amendments may come into force as early as 2027. The main intrigue is that the laws do not provide for signs of payments that can be qualified by the bank as income, which must be reported to the Federal Tax Service.
During the meeting, we will review the draft laws, analyze the rights and obligations of regulatory agencies and citizens, and discuss issues that are not reflected in the draft laws. The experts of the SPIBA Finance Committee will present their assessment of the tax control of online payments of citizens.
3. Development of the practice of challenging purchases by the Prosecutor’s Office
Transactions concluded during procurement procedures in accordance with Laws 44-FZ and 223-FZ may be challenged by the prosecutor. The basis for invalidating the transaction in such claims is a violation of the requirements of the relevant law, as well as the Law on Protection of Competition, and it does not matter who is found guilty – the customer, the contractor or both parties. At the meeting, we will tell you how the practice develops in such cases and what consequences apply to insignificant transactions.
